No. In fact, the overwhelming majority of cases against hip implant manufacturers do not include the surgeon as a defendant. Usually the surgeon has done nothing at all improper. Rather, there usually is a problem either with device’s design or manufacturing — not surgical error. In some cases, the surgeon implants the device exactly according to the manufacturer’s instructions, but the manufacturer’s instructions turn out to be incorrect.
